Domestic Violence ProceedingsEx Parte HearingsProtecting the Rights of Victims and the Unfairly AccusedTemporary Restraining OrdersDomestic abuse has many faces: all of them ugly.
For victims of domestic violence, life is a perpetual nightmare, a world fraught with fear, humiliation and isolation. The abuse may be physical— slaps, punches, kicks or beatings—or it may involve obsessive levels of control—denying you access to friends or family, taking your money, destroying your personal property, or subjecting you to verbal berating, both public and private.
For people wrongfully accused of domestic violence, the nightmare is just as real. Unfortunately, an accusation of domestic violence may be made for a variety of reasons—advantage in a divorce or custody proceeding, an attempt to punish, a way to exert power or control, or simply to be vindictive. Once you have been accused of domestic violence, your life changes dramatically.
Limits can be placed on where you can go, where you can live, who you can be with, and your right to possess certain property (such as firearms) can be curtailed or taken away forever, even if the restraining order is ultimately dismissed.
Whether you are the victim of domestic violence or abuse, or have been unfairly accused of family violence, you need an experienced, aggressive and compassionate lawyer to protect your rights. We can help.
At the Law Offices of Kelly Berton Rocco, we have protected the rights of both men and women in New Jersey since 1988, focusing our practice entirely on family law issues. We’ll take the time to listen carefully to your story, and learn what you need to feel safe and move forward with your life. Sometimes, entering into a civil protective order, called a Consent Order, is best. Many times, however, that is not an option and especially when that happens, you need skilled and experienced trial attorneys who can aggressively protect your interests in court.
Our Domestic Violence Practice
Every case is unique: there is no one solution that works for everyone. We take the time to listen to what you need and present all your options so you can make the decision that is best for you and your family. Your safety is our top priority. If you have been the victim of domestic violence or abuse, we will take swift action to protect you. We’ll help you obtain a Temporary Restraining Order (also known as a TRO). A TRO is a very powerful document. It can force your abuser out of the home (if you were living together), provide for temporary sole custody and suspend parenting time or provide for supervised parenting time. It can also provide you with the temporary possession and control of assets, such as a car, ensure the financial status quo is maintained and direct that all weapons be confiscated. In addition, it can direct your abuser to undergo evaluations for substance abuse or anger issues, among other relief. We will then help you assess whether it is in your best interest to move forward to a hearing to make the restraining order final (which would include additional or different relief) or whether it is best to attempt to negotiate civil restraints as part of a Consent Order. No matter which course we determine is best, we will be right by your side, every step of the way.
Protecting the Rights of People Unjustly Accused of Domestic Abuse
We vigorously defend people who have been wrongfully accused of domestic violence. We will work hard to either negotiate a settlement that works for both sides and if that is not possible, we will make certain that you get your day in court and that your side of the story is heard.
