Experienced Hackensack, NJ Child Custody Attorney
Custody and Parenting TimeLegal CustodyPhysical CustodyVisitationWhen your relationship with your child’s other parent has ended, one of the most difficult issues to settle can be custody and parenting time. As a parent, you want to play a meaningful role in the life and development of your child. But you don’t want them to feel like pawns, shuttled back and forth between parents’ houses. In the emotional atmosphere of divorce, it can be difficult to strike that delicate balance. We can help.
At the Law Offices of Kelly Berton Rocco, we focus our practice exclusively on family law. Since 1988, we’ve provided comprehensive counsel to both mothers and fathers regarding custody and parenting issues. There is no one “right” way to set up parenting time. We’ll take the time to learn the details of your situation, so that we can tailor our representation to help you meet your specific goals. Our attorneys will carefully explain the law and process, as well as your rights and options, so that you can make good decisions about your family and your future.
We will always first seek to amicably resolve your differences, so that you can avoid the time, expense and emotional upheaval of divorce litigation. However, we are skilled, experienced trial attorneys and are always willing and able to protect your interests in court if necessary.
Our Custody and Parenting Time Practice
We handle all matters related to a custody or parenting time dispute. We work closely with you to develop and implement a plan that considers the unique needs of your family, including any special educational, medical or religious issues. We’ll look at:
- Legal custody, or who makes decisions about the health, education and welfare of your child. Courts today generally prefer joint legal custody, where parents share the decision-making with respect to the “big” issues and both have access to your child’s educational and medical records. There are times, however, where joint legal custody is not appropriate and we will help you decide whether and how to put measures in place that are in the best interests of your child.
- Parenting time—Equal shared parenting time is quickly becoming the norm. When you have two parents who have been actively involved in raising their children, who have similar parenting styles and goals and are able to openly communicate with each other for their children and live in close proximity to each other, that is typically the best solution. However, that is not always the case. We’ll help you identify where your children will reside and when, working with you to set up an agreement governing how much time will be spent with each parent, transportation, holidays, vacations, whether the parenting time needs to be supervised or not and all other issues that relate to how to move forward and effectively co-parent your children.
